The online sale consists of making available, through the address www.hauracollection.com, for access to the online store which, in addition to providing information on a set of products and/or services, allows the final consumer/user, by electronic means, to order the products disclosed therein, under the terms and conditions described herein (“OnlineSale”).

Obvious Empathy - Unipessoal, Lda., with registered office at Calçada dos Mestres, n.º 1, 2.º right, Campolide, 1070-175, Lisbon, under the single registration and taxpayer identification number 516349520 ("Obvious Empathy"), is the rightful owner of the domain www.hauracollection.com.

Obvious Empathy reserves the right to modify freely and at any time the present Terms of Use and General Conditions of Sale in order to be compliant with applicable legislation, without the need for any prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services, whereby any change will always be published on the domain www.hauracollection.com.

Thus, Obvious Empathy reserves the right to change completely and at any time, the presentation and content of the Website. Such changes will consequently be aimed at constantly improving the website, as well as the services offered to its user. The purchaser is subject to the principles and terms in force at the date of the order unless any change is required by law or competent authority.

CONDITIONS OF USE

By accessing this domain and/or providing personal details, the user automatically declares that knows and accepts the Terms of Use and the General Conditions of Sale and the Privacy Policy. Therefore if you do not agree with all the conditions, you should not use this domain.

The navigation through the Website as well as the purchase of any product in the same presupposes the acceptance of these Terms of Use and the General Conditions of Sale contained in this page.

The user undertakes to use this Website in compliance with the provisions of the applicable legislation, refraining from using this Website for activities contrary to the law, morals and good customs, or the rights and interests of third parties and undertakes to keep, and not disclose, your password for entering the site in order to prevent third parties from accessing your account and personal data and not to use false identities.

The Website may contain links to other websites, which may contain useful information/tools for its users. These general conditions shall not apply to third party websites. As such, if you visit another website, redirected from our Website, you should read its terms and conditions and privacy policy.

The user undertakes to fully respect these rights, in particular by refraining from any acts that may violate the law or these rights, such as the reproduction, commercialisation, transmission or making available to the public these contents or any other unauthorised acts having the same content.

The Website is intended for private use only, so the reproduction, transfer, distribution or storage of the contents of the Website, without prior written permission, is prohibited for any purpose other than strictly personal use.

The linking of our Website for commercial purposes or without prior authorization from Obvious Empathy is expressly prohibited, as well as the use of the domain www.hauracollection.com for abusive purposes which will be subject to recourse to the appropriate legal means by Obvious Empathy

We are strongly committed to ensuring that the information presented on www.hauracollection.com is free of typographical errors and will correct them as soon as possible where they occur.

COMMERCIAL POLICY

Obvious Empathy sells all products and will be the entity responsible for the sale on the domain www.hauracollection.com of its products, all e-commerce services being available only to final consumers.

An "Final Consumer", "User" or "Buyer" is considered to be any person who acts / buys with a purely personal intention, outside his or her business or profession, therefore, without any desire to resell the items he or she purchases on the Website ("Final Consumer(s)" / "User(s)" / "Buyer(s)").

Product orders must be placed by Users aged eighteen (18) years or older (individuals under this age must have permission from their representatives). The elements and information transmitted by the User will have full legal effect, the User recognises the electronic purchases, and cannot allege the lack of signature for breach of the undertaken obligations.

Obvious Empathy reserves the right not to process any order received from users who are not Final Consumers or those that are not in accordance with these general conditions of sale.

The photographs presented on the Website are merely illustrative. Therefore, we recommend that you carefully check the product details for better information about the respective characteristics of the items you intend to purchase.

Prices and product specifications are subject to change without notice. Despite Obvious Empathy's best efforts to keep all information up to date, some products may contain an incorrect price, so we will check prices whenever we process orders. If the price of the product is lower than the advertised price, we will refund the difference. If the price is higher, we will inform you by e-mail and wait for your decision to accept the new offer or cancel the order.

The online store product catalog is independent from the physical stores, both in terms of price, products presented and quantities in stock. All promotional campaigns have limited stock and are exclusive to the online store.

The validation of the purchase request or order assumes that the Buyer is aware and accepts the General Terms and Conditions of Sale of the Website www.hauracollection.com.

All data recorded by Obvious Empathy constitutes proof of the set of transactions carried out between the Seller and the Final Consumer.

PLACING AN ORDER ONLINE

To place an order at www.hauracollection.com you must have a valid, frequently used e-mail account and register as a customer on this Website by completing the form available online or log in as a guest. After registering, all that is needed is to insert in the virtual shopping cart all the products that the Final Consumer wishes to purchase, following all the steps of the purchase in order for it to be successfully completed.

Placing an order at www.hauracollection.com is very easy:

  • Browse the online store pages of the Website and find the product(s) you want to purchase.
  • Add your favorite products to your shopping cart using the Add to Cart button.
  • Once you have chosen all the items you wish to purchase, finalize your purchase by clicking on Checkout.
  • Next, fill in your personal information in a very simple form (pay close attention to the address).
  • Then select your payment method.
  • Review your order.
  • Proceed to payment by confirming the order.
  • Finally, you will receive an order confirmation via e-mail.
  • By selecting the Checkout button at the end of the purchasing process, your order is confirmed and you will only have to wait for the expected days for the products to be shipped.

The Final Consumer is solely responsible for the accuracy of the personal data given to Obvious Empathy and commits to immediately enter and inform Obvious Empathy of any changes via their registration account at www.hauracollection.com.

Obvious Empathy disclaims any liability for any delay or impossibility of processing the order due to an error or insufficiency of the data communicated by the Final Consumer, particularly at the time of delivery. In the event that the Final Consumer is in breach of any of these obligations, Obvious Empathy reserves the right to delete future purchases, block access to the store, cancel the provision of any other services made available simultaneously by Obvious Empathy to the same User; and, furthermore, not allow the User future access to any service(s) made available by Obvious Empathy.

As soon as you finish your purchase, you will receive an automatic e-mail confirming the transaction. We suggest that you print or download this copy for future reference. If the data is not correct, you can immediately ask for it to be changed or the purchase cancelled.

In case of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, Obvious Empathy reserves the right not to accept your order or to cancel it totally or partially, even after automatic confirmation.

PRODUCT AVAILABILITY AND ORDER CONFIRMATION/CANCELLATION

Obvious Empathy will only process an order placed by a customer after confirmation of payment and therefore cannot guarantee the availability of products until the order is processed.

In the order confirmation you will find the estimated date of dispatch of the products after payment has been confirmed. Naturally, the estimated time for shipping may vary depending on the carrier and the destination of your order.

Obvious Empathy only ships orders on business days. Therefore, for estimating delivery time of orders, weekends and holidays are not taken into account. Any delay in shipping, compared to the estimated dates presented, does not give you the right to compensation.

The satisfaction of all orders placed on the Website is subject to product availability. Obvious Empathy tries to ensure that all items offered for sale on the Website are in stock. However, Obvious Empathy reserves the right not to accept any orders or to cancel orders already confirmed for products that are out of stock. In case of product unavailability and/or out of stock, Obvious Empathy will immediately inform the Final Consumer of the partial or total cancellation of his order, and the buyer is entitled to a refund of the amount paid.

ORDER CONFIRMATION OR CANCELLATION

At User's request:

The User may cancel his order by requesting it to Obvious Empathy through the email haura@hauracollection.pt referring to the order number, which will be accepted as long as it has not yet been processed. After processing, Obvious Empathy will try to deliver it, but the User has the option of not accepting it.

For the purpose of cancellation the User will need to provide Obvious Empathy with the following details:

  • Order number;
  • VAT number with which you placed the order and delivery address.
  • By decision of Obvious Empathy:

    Obvious Empathy may not validate the order that does not have sufficient guarantee of collection, when the order is incomplete or incorrect, or when the products ordered are no longer available. In any of these cases, Obvious Empathy will inform the Final Consumer via e-mail that the sales agreement has not been entered into and that Obvious Empathy has not proceeded with the sale, specifying the reasons for this.

    If products ordered on www.hauracollection.com are no longer available at the time of your last access to the Website, despite having obtained order confirmation, or when Obvious Empathy receives your order, the Seller will immediately inform you of their unavailability, never later than 30 days after receiving your order.

    If an order has been placed, and payment made, for products that have become unavailable, Obvious Empathy will refund the money paid for unavailable items.

    Obvious Empathy reserves the right to refuse any order for any reason and disclaims liability for any damages or costs and reserves the right to cancel any purchase even if it has already been accepted or confirmed by Obvious Empathy, namely in the following situations:

  • The information on the invoice is not correct or verifiable;
  • The order is flagged by the site's Security Systems as an incorrect, irregular order, or an order susceptible to fraud;
  • When the transfer of the payment of the order has not been received within a period of 2 working days following the acceptance of your order;
  • When it is not possible to deliver the order to the address provided by the User;
  • If it is considered that the Buyer did not have the capacity to perform that act.
  • If it is verified that there was an error in the presentation of the price of the product(s);
  • If it is assumed that the order comes from a reseller.
  • PAYMENT CONDITIONS AND SECURITY GUARANTEES

    The available payment methods will be presented at www.hauracollection.com. We do not accept any other method of payment besides those mentioned.

    PAYMENT METHODS

    You can pay for your products using your usual credit and debit cards (Visa, MasterCard, Amex), using Apple Pay or using your personal Paypal account.

    You can also pay your order through MB Way, ATM (Multibanco), being provided with all the necessary instructions for this payment method (entity/reference/total amount) or by Bank Transfer to the following data:

    *NOTE: For payments made by Bank Transfer, if it is not possible for some reason to send proof of payment, please contact us so that we can confirm and consider the order as completed as soon as possible.

    If the Final Consumer chooses to pay by ATM, we will only start processing the order once we have received the payment. Therefore, with this method of payment, we advise you to go to the ATM as soon as possible so that you receive your order as soon as possible. Once 2 calendar days have passed since the order was placed, and if we have not received any payment, the order will be cancelled.

    The purchase price of the products and shipping costs, as indicated on the order form, will be charged to your current account when the purchased products are actually shipped.

    We urge you not to attempt to make payment by any means not specified at www.hauracollection.com. If you do, Obvious Empathy cannot be held responsible for lost payment or any other damages that may result.

    RESERVATION OF OWNERSHIP OF PRODUCTS SOLD

    Obvious Empathy retains ownership of the products until it has received full payment for all such products.

    PRICES

    The prices of products displayed on www.hauracollection.com contain Value Added Tax (VAT).

    The total price specified in the final menu includes taxes and shipping costs. Prices are quoted upon order confirmation, which you can print or download for future use. Please transfer only the exact amount specified in the order confirmation and make individual transfers per order.

    Shipping fees are calculated per order, and the exact price of the shipping fee will depend on the country where your order will be delivered.

    The prices are all broken down in Euros and any change in the country where the order is delivered may have an influence on the prices due to transportation costs.

    QUALITY AND WARRANTY

    Obvious Empathy will only sell on www.hauracollection.com quality items and will never sell second hand, defective or sub-standard products.

    Products offered for sale on www.hauracollection.com may not exactly match the actual clothing in terms of displayed image and colors, especially due to the internet browser and monitor used.

    SHIPPING AND DELIVERY

    Shipping charges associated with your order will be billed per order, i.e. if you order more than one item, you will only pay shipping charges once.

    However, Obvious Empathy reserves the right to split the delivery of the order, for example if a part of the order is delayed or not available. In case we do split the order, the customer will be notified of our intention by e-mail. For this purpose the e-mail address provided by the customer at the time of purchase will be used.

    Delivery process

    The process of sending orders will begin after confirmation of payment of the respective order.

    Once the order is shipped, the customer will be notified via e-mail with the shipping number assigned and a link to track the order on the carrier's website.

    The shipping information may take up to 24 hours from receipt of the shipping confirmation to be updated on the carrier's website without any liability to Obvious Empathy.

    Products ordered on the Website will be shipped and delivered on business days, Monday through Friday.

    We can only guarantee the successful delivery of an order if the shipping address of the products is correctly indicated by the User.

    A delivery is considered made or a product is considered delivered when the delivery receipt is signed at the agreed address.

    After your order is registered, your payment is confirmed and all items in your order are available, your order will be delivered by the carrier in a maximum period of 30 days but shall be delivered within the following deadlines:

    If you do not receive your order within the estimated delivery time above, we ask for your understanding and that you email us at haura@hauracollection.pt.

    The order will be shipped to the recipient and address indicated. The address given is the sole responsibility of the customer.

    NOTE: In case it is returned, the costs of reshipment will be borne by the customer.

    The above costs will be automatically updated upon completion of the order and do not include any import taxes that may be charged upon entry into the customer's country of destination.

    For all shipments to countries within the European Union, prices include VAT. Orders shipped to countries outside the European Union or with different customs and tax policies than most European Union countries, may be subject to taxes, duties and fees levied in the destination country (Import Charges). The recipient of an international shipment may be subject to Import Charges at the time the shipment arrives to the country. The recipient may incur additional customs clearance charges. Obvious Empathy does not keep track of these charges nor is it able to make an estimate. Customs policies vary widely from country to country and the customer should contact their local customs office for more information. When customs clearance procedures are required, there may be a delay from the estimated shipping time.

    IMPORTANT INFORMATION

    All orders require a signature upon delivery. Obvious Empathy cannot change the delivery address of orders once those are dispatched. The above delivery times are indicative only, and do not take into account delays caused by problems with payment authorizations or customs clearance in the destination country.

    ORDERS DELIVERY

    The customer is requested, upon delivery of all shipments, to carefully inspect the box BEFORE signing the delivery document. All Obvious Empathy packages are sealed.

    If for any reason the packaging appears tampered with, please sign the delivery document with reservations, or refuse delivery, which should be returned immediately to the same address indicated on the order box.

    If you accept delivery of the order with reservations, or refuse delivery, please immediately complain to the carrier and contact Obvious Empathy at haura@hauracollection.pt.

    Obvious Empathy will proceed to refund the amounts paid for the order and shipping as soon as it receives and completes the return process at its headquarters.

    The order is deemed accepted if, after receiving the order, the Buyer does not return the order within 15 days.

    NON-DELIVERED ORDERS ATTRIBUTABLE TO THE USER

    If your order is not successfully delivered to your address due to any reason attributable to you under your commercial agreement with Obvious Empathy, you may be entitled to have your order returned to Obvious Empathy at your expense, including any import taxes that may be charged on re-entry into Portugal in the case of shipments to non-EU countries. These costs will be deducted from any eventual refund.

    NON-DELIVERY ORDERS ATTRIBUTABLE TO OBVIOUS EMPATHY

    If for any reason attributable to Obvious Empathy it is not possible to deliver the ordered items within 30 days of order confirmation, you will be offered a new delivery date. If this new date is not convenient for you for any reason, you may terminate the agreement without any charge or expense to you. You will be reimbursed for all amounts paid within 30 days of termination.

    Obvious Empathy will not be liable for any failure, or delay in performance, of any shipping obligation due to a force majeure event, i.e. an event, act or omission beyond its reasonable control.

    An incorrect or incomplete delivery address may result in the order being returned to Obvious Empathy and result in additional costs to the customer, therefore it is recommended that the customer always ensure that the delivery address given when registering the order is correct and complete.

    Once the order has been registered it is not possible to change the indicated billing data. The delivery address cannot be changed by Obvious Empathy, however you can change your address by contacting our carrier and requesting a change. This request should be made as soon as possible (within the carrier's delivery times).

    EXCHANGES AND RETURNS OF PRODUCTS

    All products are individually identified with a security tag. If you wish to return the purchased product, do not remove the label from the purchased product.

    Should you decide to return the purchased products, Obvious Empathy has the right not to accept the return of products if the returned products are not in the condition in which they were delivered, contain usage marks, have been washed or do not have the corresponding label, or when the labels have been altered from their original state or damaged.

    After receiving the order, the Buyer has a period of 15 days to exchange the item(s) only in case of incorrect size.

    Obvious Empathy only allows exchanges of a different size of the purchased item. If you want to exchange for another item, a voucher will be issued for the value of the exchange so you can proceed with the new order.

    The User, in case of a consumer, can exercise the right of resolution without being required to pay any compensation, within 14 (fourteen) days from the day on which the consumer acquires physical possession of the good.

    To exercise this right, the User may use the draft indicated below, indicating all of his/her identification data, the subscribed service that he/she wishes to resolve and the subscription date. The communication must be made, by letter, by returning the purchased good, or by any other appropriate and provable means within the timeframe defined above.

    The Final Consumer must within 14 (fourteen) days from the date of communication of the resolution return the goods to Obvious Empathy in the proper conditions of use.

    Draft for free withdrawal form (you should only fill in and return this form if you want to withdraw from the agreement):

  • To (insert here name, geographical address and possibly e-mail address);
  • I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) agreement of sale of the following goods (*) - ordered on (*) and received on (*);
  • Name of consumer(s)
  • Address of consumer(s);
  • Signature of consumer(s) (only if this form is notified on paper.).
  • (*) Delete where not applicable.

    Obvious Empathy shall, within 24 hours, acknowledge to the Final Consumer receipt of the withdrawal declaration on a durable medium.

    The package must be returned complete, as delivered and accompanied by all the documentation received, including the following documents: sales invoice and the document that proves receipt of the product. The package and the documents indicated should be sent free of charge to the following address:

    The costs with shipping will be supported and the responsibility of the User (except for quality reasons).

    The exchange or return of the buyer's order should be done through the same carrier that delivered the items to your address, as follows:

  • Place the item in the box. You can use the original packaging where you received the order or another cardboard box, provided it is not damaged. If you use the original packaging, empty it and put only the item you want to return. Close the box and seal it with tape. If the box has any labels, stickers or other materials from previous shipments, remove them.
  • The package should be sent by CTT or carrier, to the address indicated on the package.
  • Upon receipt of the product, Obvious Empathy will verify that the item meets our requirements for Exchange or Return. If so, the exchange will be confirmed or the chargeback made.
  • To refund the amount paid, Obvious Empathy makes two options available to the User: issuing a voucher for the value of the returned items, which can be discounted only in the online store within a maximum period of 6 months from the date of issue; or the chargeback itself, through the same payment method used in the purchase.
  • After receiving all or part of the ordered products at our facilities, we will process them. If the return is confirmed, the amount will be refunded to you by the same method of payment. Refunds are only made to the account/card that originated the purchase. The refund is made within 14 days after receipt of the free will and receipt of the returned goods. In the case of a simple exchange of an article, color or size, then, after checking the availability of that product, it will be sent to the address indicated in the exchange process.

    If any of the components of the sold item is missing, or if any of them is not in excellent condition, there will be no refund of the price or shipping costs, and the product will be sent again to the initial shipping address.

    ORDER CANCELLATION

    Before shipping, the Buyer can cancel the order of products. If the User places an order and wishes to cancel it, he/she should first check the status of the order via the My Account menu, situated at the top right of the main page of the Website www.hauracollection.com, then click on Orders and if the order status mentions Dispatched, then there is the possibility that it can still be cancelled. For this, the User should contact our Customer Support Service and request the cancellation of their order via haura@hauracollection.pt.

    If the cancellation request is successful, the customer will be notified by e-mail of this decision and the cancellation will be processed at no cost to the customer.

    If the cancellation request is not possible because the order has already been shipped, the products will be sent to the Buyer who, if he maintains his intention to cancel the order, must refuse to receive them by activating the return mechanisms on the Website.

    Upon confirmation of the return and receipt of the order, the respective chargeback will be processed.

    CONDITIONS APPLICABLE TO PROMOTIONAL CODES (DISCOUNTS)

    When used in accordance with the established rules, a promotional code entitles the user to benefit from a promotion/discount on the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/promotional campaign.

    Promotional codes are personal and non-transferable and can only be used on online purchases made on the Website. It is not permitted to sell, exchange or give away a promotional code. The customer holding the promotional code may not upload or make available a promotional code on any website or other public offer, giveaway, sale or exchange. Use of promotional codes for commercial purposes is not permitted.

    The use of a promotional code is limited to one use per product per order. Promotional codes cannot be combined with any other promotions or special offers.

    Promotional codes cannot be exchanged for cash and will not be re-issued or refunded.

    Without prejudice to any other rights, Obvious Empathy reserves the right to immediately invalidate a promo code issued if it suspects that a promo code is being used in violation of the above.

    VALIDITY OF PROMOTIONS OR COMMERCIAL CAMPAIGNS

    Promotional offers or commercial campaigns advertised on www.hauracollection.com are valid only for the time at which they are displayed on the Website and in accordance with the conditions set out, unless otherwise communicated on the Website.

    In case of return or exchange of articles purchased under commercial campaigns or promotions, you will be credited or delivered only the amount you actually spent on the purchase of the item you want to return or exchange.

    The conditions for returning orders placed during campaign/promotion periods may be altered.

    LIABILITY

    Obvious Empathy will only be liable for damages suffered by the Buyer where such damages result from breaches of Obvious Empathy's contractual obligations to the Final Consumer or where liability results from applicable law.

    Where the Buyer has suffered damage in connection with the activity on the Website, Obvious Empathy's liability shall be limited to damage on the products available on the Website and to reasonable and verifiable costs incurred by the Buyer as a result of Obvious Empathy's breach of these General Terms and Conditions of Sale.

    Obvious Empathy shall not be liable for any damages suffered by any third party resulting from the use of any of our products. Obvious Empathy cannot be held liable for damage suffered by the Buyer as a result of misuse of our products.

    Obvious Empathy is not liable for damages that result from incorrect information on the Website. Obvious Empathy cannot guarantee the absence of viruses or similar elements in electronic documents and files stored on its computer system and website, and therefore cannot be held liable for any damage caused and derived from the possible presence of viruses and other similar elements.

    All products sold by Obvious Empathy comply with Portuguese legislation.

    Obvious Empathy declines any responsibility in case of violation of the legislation of the country where the order is delivered. It is up to the end user to check with the local authorities the conditions of import or use of the products he/she wants to order.

    INTELLECTUAL PROPERTY

    Intellectual property rights

    All the contents of this Website are the exclusive property of Obvious Empathy. As such, they are protected by applicable law.

    The user undertakes to fully respect these rights, in particular by refraining from any acts that may violate the law or these rights, such as the reproduction, commercialisation, transmission or making available to the public of these contents or any other unauthorised acts having the same object.

    CLAIMS

    In case you have any questions or complaints, please contact Obvious Empathy via e-mail to haura@hauracollection.pt.

    The User may submit any contractual conflicts to the mediation and arbitration mechanisms that are or will be legally constituted, as well as complain to Obvious Empathy of acts and omissions that violate the legal provisions applicable to the acquisition of goods.

    The complaint should be presented within a maximum period of 30 (thirty) days, counting from the knowledge of the facts by the User, being registered in the information systems of Obvious Empathy that will decide the complaint and notify the interested party within 30 (thirty) days from the date of receipt.

    APPLICABLE LAW

    These Terms and Conditions and all disputes arising in connection with these Terms and Conditions, including their validity, the use of the website www.hauracollection.com or any purchase thereof shall be governed and interpreted in accordance with Portuguese law.

    In case of dispute regarding the interpretation or execution of the present Conditions and General Terms of Sale, Obvious Empathy and the Buyer agree to work towards an amicable solution, which is fair and adequate, within a maximum period of 60 (sixty) days from the reception of the communication addressed to this effect by any of the parties involved.
